Art sector
Licenses for the reproduction of artworks by national and international artists. The Art team is responsible.
Audio sector
Exploitation of rights in literary works that are used in radio or television broadcasts. The royalties come from SRG and other broadcasting companies.
Author
An author is the person who creates a work. This person automatically holds the copyright and can (like any rightsholder) consent to certain uses or prohibit uses. Authors conclude contracts with publishing houses, with collective management organizations, or with other persons. In this way, they exercise control over their rights.
Broadcast distribution
Distribution of statutory royalties for texts and images that were used in a radio or television broadcast. Unlike in the Audio area, the royalties come from the retransmitters of such programs, not from the broadcasting companies. The responsible unit is Team Works.
Common tariff (CT)
Tariff that several collective management organizations jointly set for statutory royalties (ProLitteris, SUISA, Suissimage etc.).
Cooperative membership
Relationship of a rightsholder to ProLitteris as a cooperative. Cooperative membership requires a rights administration agreement. It is a prerequisite for social benefits for authors and for participation in the general assembly.
Copying levy
Statutory royalties for reproducing or sharing works and performances in education, at work, in associations and in other areas of society.
CT 10
Common tariff for the conversion of works for people with a disability.
CT 11
Common tariff for the use of archive works of broadcasting organizations, insofar as no contractual solutions exist.
CT 13
Common tariff for the use of orphan works (rightsholders not or not fully known and traceable).
CT 5
Common tariff for the rental of copies of works by libraries and video rental stores.
CT 7
Common tariff for copying levies in education. Schools and organizations that run courses for external persons are liable to pay.
CT 8
Common tariff for copying levies in companies and other organizations.
Emergency assistance
Emergency assistance is a one-time social benefit for members of the ProLitteris cooperative who submit an application. The conditions of the regulations of the Welfare Foundation apply.
Exploitation agreement
Agreement for the transfer of rights to ProLitteris. The content of the exploitation agreement is defined by the exploitation terms and by the exercise of rights and obligations by the rightsholder and by ProLitteris.
Expo distribution
Statutory royalties for exhibited visual works (artworks and similar objects). Available to rightsholders with an exploitation agreement and a valid declaration of works. Part of the annual main distribution. The Works team is responsible.
Extended collective license (ECL)
License from ProLitteris that also applies to rightsholders who are not affiliated with ProLitteris (Art. 43a CopA).
License
Permission to use copyrighted works or performances, either in the form of a contract (contractual license, contractual royalty) or a statutory provision (statutory license, statutory royalty).
Licensee
Licensees are paying users. They apply to ProLitteris for a license, or they are requested to declare usage data and receive an invoice. The legal basis is always the Copyright Act.
Main distribution
Annual distribution of the statutory royalties and most international royalties by ProLitteris. The main distribution consists of several distributions (distribution systems).
Mandatory collective management
Statutory management of certain rights and uses by a collective management organization, without any choice for the rightsholders.
Membership
Affiliation of rightsholders with ProLitteris by concluding a rights administration agreement. As a rule, this is a condition for participating in distributions and receiving royalties. In addition, cooperative membership as a “plus” with further benefits is possible.
MyCopyright
Digital sealing and depositing of documents and files as evidence in copyright law, in other areas of intellectual property and for other purposes.
Online distribution
Statutory royalties for works on the internet (online media and similar content). Available to rightsholders with an exploitation agreement and a valid declaration of works by a publishing house as the operator of a website. Part of the annual main distribution. The responsible unit is Team Works.
Print distribution
Statutory royalties for printed works (books, newspapers, magazines). Available to rightsholders with a rights administration agreement and a valid declaration of works. Part of the annual main distribution. The Works team is responsible.
Retirement pension
The retirement pension is an annual social benefit for long-standing members of the ProLitteris cooperative who are of retirement age, have a low income and have reached a relevant royalty amount from the exploitation of rights. The conditions of the regulations of the welfare foundation apply.
Rightsholder
A rightsholder is any person or organization that holds rights in a copyrighted work or a protected performance. Rightsholders can be:
Supervision
Supervision at ProLitteris includes the supervisory board, tariff supervision by the Federal Arbitration Commission for the Exploitation of Copyrights and Related Rights (ESchK), management supervision by the Swiss Federal Institute of Intellectual Property (IGE), and supervision of the foundations.
Tariff
Standardized prices and conditions for the use of copyrights and related rights. Tariffs originate from a collective management organization or jointly from several collective management organizations (common tariff, CT).
User
Users are individuals or organizations that use or are allowed to use copyright-protected works or services. Uses concern the copyrights of rightsholders. Some uses are assessed specifically (individual royalties), others are assessed statistically (lump-sum royalties).
Voluntary collective management
Contractually organized management of certain uses by a collective management organization, with an option for rights holders to choose. Participation is voluntary, certain exceptions are possible.
Work
Individual creation of a person, for example text, image, audio, video. Copyright applies to the work.
