The use of protected works is legally privileged if it is limited to the personal circle: relatives and friends. A royalty for storage media compensates authors, publishing houses and other rights holders for the fact that they cannot assert any rights in this area.

Private uses in schools and organizations

The legally permitted private use within the personal circle is exceeded when a person attends a school or offers classes themself and when a person carries out a professional activity. In these cases statutory royalties are owed to ProLitteris. Common tariffs and apply. The organization in which the classes take place or in which can be used for internal information and documentation is responsible. The type and conduct of the specific persons are irrelevant. The royalty owed to ProLitteris is independent of the texts, images, audios and videos that are reproduced or distributed internally. Persons with a sole proprietorship or another self-employed professional activity are also affected by CT 8 and are therefore invited by ProLitteris to declare their data and pay a royalty.

Extended collective licenses

Digitization projects and similar projects

Extended collective licenses are suitable for your projects with large quantities of protected. Companies, archives, libraries or museums can carry out digitization projects. The extended collective license is available under copyright law only from ProLitteris (Art. 43a CopA). It is also possible if not all authors can be identified or contacted.

Use of works of art

Thanks to an international network with partners such as VG Bild-Kunst and ADAGP, ProLitteris holds the reproduction rights to numerous contemporary artists of international standing. Use the artist search and ask ProLitteris about permitted uses. Uses without a license are not allowed and subject to a fee.

You need a license from ProLitteris in advance for every use. It is always granted by ProLitteris and not by the artists concerned. For monographic, large-format or commercial uses as well as for altered or incomplete representations, we coordinate with the rights holders where necessary.

ProLitteris also prohibits the automated analysis of for text and data mining purposes in accordance with Art. 4 of Directive (EU) 2019/790 for texts and images in the and for uses by broadcasting organizations.

Orphan works

Texts, images, audios or videos from public collections

If are held in a collection, museum or archive of the Confederation, the cantons or the municipalities, ProLitteris can authorize certain uses in accordance with tariff (orphan works) or by means of an extended collective license (ECL) against an appropriate royalty. Orphan works are works whose rights holders are unknown or cannot be found. ECL are possible for a larger number of works, provided that the use does not affect the normal management by the rights holders. Contact ProLitteris and examine these options.
