Companies, public administrations and other organizations can copy, scan and distribute protected works internally in analog and digital form. A royalty according to an official tariff (CT 8) is legally due for this. ProLitteris offers additional licenses and ensures correct royalties for authors, publishing houses and other rights holders.

Legal certainty from CHF 32 per year

ProLitteris invites organizations every year to declare the number of positions (full-time equivalents). The royalty is then calculated. The tariffs ( and ) are approved by the state. They include a basic royalty, a royalty for press reviews, a royalty for teaching and a royalty for copying services for third parties. Providing information to ProLitteris is a legal obligation. Mail from ProLitteris

ProLitteris writes to companies and asks them for information about the organization, the industry and the number of full-time positions. ProLitteris is obliged to do this by the Swiss Federal Act on Copyright (CopA). The declaration is necessary and required by law.

Often these are young companies that are invited to declare their data. However, it also happens that older companies are contacted that do not yet pay copying levies. ProLitteris receives data from the Federal Statistical Office and from the commercial register. In addition, a complete and reliable recording of all organizations cannot be guaranteed due to operating conditions. This can lead to one organization receiving mail and another organization not.

Use of art clearly regulated

Thanks to an international network of partners such as VG Bild-Kunst and ADAGP, ProLitteris holds the reproduction rights of globally renowned contemporary artists. Use the artist search and obtain information from ProLitteris about the permitted uses. Uses without a license are not permitted and subject to a fee.

For each use you need a license from ProLitteris in advance. It is always granted by ProLitteris and not by the respective artists. For monographic, large-format or commercial uses as well as for altered or incomplete representations, we coordinate with the rights holders where necessary.

ProLitteris also prohibits the automated analysis of for text and data mining purposes according to Art. 4 of Directive (EU) 2019/790 for texts and images in the as well as for uses by broadcasting organizations.

Artificial intelligence

License internal AI uses

You use AI in your professional activity and process texts or images of third parties? The extended collective license (ECL) from ProLitteris enables organizations to legally secure certain internal AI uses under copyright law without having to obtain individual licenses for each work.

The license applies to lawfully used texts and images and covers exclusively internal AI uses in Switzerland. External publications or the use of the content for training AI systems are excluded. The royalty is a flat rate and amounts to a few francs per position and year.

Many organizations use AI in their daily work. The extended collective license (ECL) from ProLitteris offers legally secured licensing for this.

Use of protected works in digitization projects and similar activities

Extended collective licenses are suitable for your projects with large quantities of protected. Companies, archives, libraries, or museums can carry out digitization projects. Under the Copyright Act, the blanket license is available exclusively from ProLitteris (Art. 43a CopA). It is also possible if not all authors can be identified or contacted.
