From evidence to the use of your works

In copyright law, there is no register, unlike in patent law for inventions. However, digital content can be copied, modified, and shared particularly easily. With artificial intelligence (AI), such uses have become even more widespread. How can you later prove that you are the author of an idea, a draft, or a work? 

creates an infrastructure for digital assets and accompanies creative work. Our concept follows three stages: Evidence, Asset, and Market (licensing).

MyCopyright does not create copyrights. Copyright protection arises automatically, provided that the legal requirements are met: a human creation with elements that are sufficiently individual. However, MyCopyright enables you to prove the existence of a file, the time of its creation, and information about it. Thanks to qualified identification by Swisscom, it is also possible to establish the person behind it beyond doubt.

The use of MyCopyright currently requires a management agreement with ProLitteris (membership), in the role as author. The service will later be made available to publishing houses and other persons. The infrastructure is being continuously expanded and is also suitable for other forms of intellectual property as well as for concepts or trade secrets.

MyCopyright is being developed jointly by ProLitteris and Swiss Trust Layer and expanded step by step. A partnership with other collecting societies is in preparation.

Sealing files

Evidence

We provide your documents and files with a digital fingerprint and a timestamp. Your certificate proves at any time that a specific file existed at a specific point in time. This information is stored immutably in a blockchain by Swisscom. For the file itself, you choose a simple storage location or a higher security level in Switzerland. For CHF 5 per year, provides you with a folder for numerous files with the possibility of sealing and depositing four additional versions in the same way. The file can be made accessible to others: you also have evidence for this, and thanks to qualified identification, you can be certain which natural person received the file. With this procedure, you avoid AI models and other services on the Internet being able to access your data.

Depositing files

Escrow

offers qualified identification of the person who submits a file. To do this, you use your passport and the camera on your device (computer, smartphone). The data is encrypted and stored independently. We use a KYC process (know your customer) from our partner Swisscom Trust Services AG, a subsidiary of Swisscom. Linked to this is particularly secure, sovereign storage of the file in Switzerland. You can avoid having the file stored in a cloud on the Internet that could enable other actors to access data. The identified person can obtain the file again from ProLitteris at any time by identifying themself in the same way as during the first identification. This process (recovery) is possible online or physically at ProLitteris – later also at other collecting societies that use our system. Our escrow is a particularly reliable safeguard for important documents and files.

Labeling content

Content Labels

ProLitteris expands the labels that were published by the EU Commission in summer 2026 as possible, but not mandatory, markers. First, MyCopyright adds self-declaration on AI use to the digital fingerprint of the file, which is stored in the blockchain of Swisscom Trust Services. Second, ProLitteris expands the labels AI GENERATED and AI MODIFIED with the additional labels AI FREE and AI ASSISTED. Further labels are added that serve the opposite perspective: HUMAN AUTHORED and HUMAN APPROVED – both labels require qualified identification of at least one natural person.

AI FREE = HUMAN AUTHORED

Human content without any AI contribution. The definitions of AI FREE and HUMAN AUTHORED correspond, but the conditions for use differ. The content was generated entirely by humans. A minimal technical, preparatory, or checking use of AI without any influence on a determining element is disregarded. Examples include a text with machine spell check, a photo with simple light correction, a music or voice recording with noise reduction, or an unchanged smartphone video.

AI ASSISTED

Human-determined content with AI contribution. The content was predominantly generated by humans, but at least one determining element was generated or modified with AI. Humans create the content, but AI contributes at least one determining element: for example, the headline of an article, the background of an image, an additional voice in a recording, or a generated video sequence.

AI MODIFIED

Existing content with AI modification. The content is based on existing content and was modified with AI in at least one determining element. AI modifies or supplements at least one determining element in existing content: for example, the message of a text, a person in a photo, the spoken words in an audio recording, or the depicted sequence of events in a video.

AI GENERATED

AI-determined content. The content was generated entirely, predominantly, or in its determining elements with AI. Based on a prompt or chat, AI generates a complete article, an illustration, a music or voice recording, or a video clip. Content that is predominantly generated by AI with individual human corrections also falls under this label.

HUMAN APPROVED

Content checked and approved by humans. The complete content was checked and approved by at least one identified human. This person and/or a designated organization assumes responsibility for it. An identified person checks and finalizes complete content before publication: for example, a manuscript, a customer letter, a media release, a social media post, an advertising graphic, or an informational video.

Rules for use and combination

The labels HUMAN AUTHORED and HUMAN APPROVED are only available to persons with qualified identification. Identification is carried out via a KYC process with a passport document. Swisscom Trust Services provides the technical solution and trust services. Each piece of content is assigned one of the labels AI FREE, AI ASSISTED, AI MODIFIED, or AI GENERATED. HUMAN AUTHORED can only be combined with AI FREE, HUMAN APPROVED with all labels. In cases of overlap, the following order applies: AI GENERATED, AI MODIFIED, AI ASSISTED, AI FREE. The label applies to a specific version. Changes may result in a new label. For composite content, the label applies to the entire content; differing determining components can additionally be identified.

We are developing MyCopyright further

ProLitteris is planning and building a trust infrastructure for digital content, supported by collecting societies in Switzerland and abroad. The basis continues to be the sealing and depositing of content and the qualified, certified, and encrypted identification of humans who deposit a file and further information. Later, the offering is intended to become a central register of files and rights, with the possibility of granting or refusing licenses for artificial intelligence (opt-out). This infrastructure draws on ProLitteris as a competence center in copyright law and in the definition and administration of rights, on the experience and competence of the IT company Swiss Trust Layer in the development and operation of security services, and on the partner Swisscom Trust Services as a leading company for digital signatures and long-term secure encryption. 

Assessing rights (Detection)

is preparing functions to better assess the rights to content. On request, ProLitteris can determine the likely share of artificial intelligence or the likelihood that content will be recognized as a work protected by copyright. In addition, advice on copyrights, personality rights, and patent, trademark, and design rights is planned.

Copyright Office (directory) – in planning

The development of copyright law in the AI age is uncertain. For this reason, ProLitteris plans for and information on the rights claimed or managed to be findable in a register maintained by collecting societies and other rights holders.

Licensing rights (management) – in planning

At a later stage, a Copyright Office is intended to simplify the licensing of rights jointly with other collecting societies. The focus – depending on the legal framework – is on licensing certain uses by artificial intelligence.
